The disputed domain name <priligy_t4n_s2a.net> is registered with Regulaxy.
3. Procedural History
The Complaint was filed with the WIPO Arbitration and Mediation Center (the“Center”) on March 14, 2009. On March 14, 2009, the Center transmitted by email to Regulaxy a request for registrar verification in connection with the domain name at issue. On March 14, 2009, Regulaxy transmitted by email to the Center its verification response confirming that the Respondent is listed as the registrant and providing the contact details.
The Center verified that the Complaint satisfied the formal requirements of the Uniform Domain Name Dispute Resolution Policy (the“Policy” or “UDRP”), the Rules for Uniform Domain Name Dispute Resolution Policy (the “Rules”), and the WIPO Supplemental Rules for Uniform Domain Name Dispute Resolution Policy (the“SupplementalRules”).
In accordance with the Rules, paragraphs 2(a) and 4(a), the Center formally notified the Respondent of the Complaint, and the proceedings commenced on March 20, 2009. In accordance with the Rules, paragraph 5(a), the due date for Response was April 11, 2009. The Respondent did not submit any response. Accordingly, the Center notified the Respondent’s default on April 18, 2009.

The Complainant is a pharmaceutical company with its principal office in Wilmington, Delaware, United States of America, registered under the Registration in the United States of America mark “priligy.” Complainant was founded in 1981 by former members of a group known as the “White Horse” who were seeking to promote and expand their family’s business. The Complainant is incorporated by the laws of Delaware and the United States of America.
In 1993, the United States Patent and Trademark Office, having exclusive rights over certain patented compounds and the trademark Priligy, was established in the United States. The mark Priligy is a trade mark of Pfizer Inc. and is commonly used to promote the sale of pharmaceuticals. The Complainant is also registered with the UDRP. The Complainant is currently using the mark Priligy for the sale of misbranded prescription drugs, including the antacids used for heartburn and indigestion. The Complainant registered the trademark Priligy on August 6, 1990. Priligy was a trademark that was not registered to the Complainant on August 6, 1990. The Complainant is the owner of an exclusive right of control over Priligy. The Complainant’s trademark Priligy is identical to the Complainant’s trademark. Priligy was a prescription drug and was marketed for use by the Complainant on May 30, 1990. The Complainant’s trademark Priligy was transferred to the Complainant on August 2, 1990.
The Complainant is engaged in the practice of law in the United States. The Complainant is a registered trademark of the Complainant’s United States registered trademark Priligy. The Complainant is using the trademark Priligy as a trademark for the use of prescription drugs. The Complainant has no rights in any of the Complainant’s trademarkes.
